William Henry Shively, Son Of Henry Shively And Mary Ann Chambers, Who Lived In Hancock County, Ohio

A Mother's Civil War Pension Claim

William Henry Shively, son of Henry Shively and Mary Ann Chambers, was born on 24-May-1842 and died 12-Apr-1866.  He is buried in the Hickory Grove Cemetery in Hancock County, Ohio.  William Henry Shively (W. H.)  Shively enlisted in Company B of the 21^st Regiment Ohio Volunteer Infantry during the Civil War.  He was captured during the battle of Chickamauga, GA on 20-September-1863 and sent to Andersonville prison.  While there he became ill and later died in Hancock County, Ohio from diseases contacted while in prison.

William H. Shively filed the following Claim For Invalid Pension:

State of Ohio, Hancock County

On this 17^th day of October, 1865 before me, the undersigned, a William H. Shively a resident of Hancock County in the State of Ohio who being duly sworn to law, declares that he is the identical William H. Shively who was a Sergeant in Company “B” commanded by Lieut Mason in the 21^st Regiment of the Ohio Infantry Volunteers commanded by Colonel James Neibling; that he volunteered at Findlay in the State of Ohio on or about the 16^th day of September 1861 for the term of three years and was honorably discharged at Columbus Ohio on the 9^th day of May 1865 as will appear by his certification of discharge herewith presented.

That while in said service at the battle of Chickamauga he was taken prisoner Sept 20^th 1863 and while a prisoner in rebel hands at Andersonville Georgia about the 20^th day of August 1864 he contracted a disease called scurvy and became generally debilitated, and being sent to hospital on the 26^th day of August 1864 his liver became diseased and chronic diarrhea set in during the winter of 1864-1865 and that the said disease of liver still continues and also the chronic diarrhea to such an extent as totally to disable him from making his living by his manual labor, that said diseases were contracted in the service of the United States.

He makes this declaration for the purpose of being placed on the Invalid Pension Roll of the United States, by reason of the disability above stated; and hereby constitutes and appoints Jacob B. Dunn of Findlay Ohio his Attorney to prosecute this claim and procure a Pension certificate, that my Post Office address is Vanlue, Hancock County, Ohio.

I have the honor to acknowledge the receipt from our Office of application for Pension, and to return it herewith, with such information as is furnished by the files of this Office.

It appears from the Rolls on file in this Office, that William H. Shively was enrolled on the 19^th day of Aug, 1861, at Findley Ohio in Co. “B”, 21 Regiment of Ohio Volunteers, to serve 3 years, or during the war, and mustered into service as a Private on the 19^th day of Sept 1861, at Findley Ohio, in Co. “B”, 21^st Regiment of Ohio Volunteers, to serve 3 years, or during the war.  On the muster out Roll of Co. “B” of that Regiment, dated July 25, 1865, he is reported a Sergeant and “Absent, prisoner, Captured at Battle of Chickamauga, Ga  Sept 20, 1863”. No evidence of disability on file.  Said soldier was mustered out May 9, 1865”

I William P Wilson on oath say that I reside in Hancock County Ohio, and have been a physician and surgeon for more than fifteen years, and late pension surgeon for said county;  that I was well acquainted with William H Shively, late Serg. Co B 21^st Ohio Vols, before he entered said service and know that his health was at that time good,  that he was under my medical charge from the 10^th of May 1865 most of the time until his death which occurred on the 12^th day of April 1866.  That on the 10^th day of May 1865 he was suffering from derangement of the liver and chronic diarrhea, and that the chronic diarrhea continued until, and was the cause of his death.  That for a part of the time after he left the regiment he was in such condition as to walk about with tolerable cause, but he was at no time fit for labor to any considerable extent.  That I believe said disease was contracted in rebel prison at Andersonville, Georgia, and am satisfied that medical evidence of the origin of the disease cannot be obtained.  That I have no interest in the claim of Mary W Shively (his mother) for a pension, and personally know the above facts except where stated as matter of belief.                                    W.P. Silas Shively And Wife Amelia Bentz Who Lived In Goshen, Elkhart County, Indiana

Information on Silas Shively and wife, Amelia Bentz, is found in the Elkhart County, Indiana records.  The obituary for  Silas was extracted from The Elkhart Daily Review, Tuesday, October 6, 1896, Page 3, Column 2:    Silas Shively, aged 58 years, and an old resident of this city, died at his home, 417 South Sixth street, yesterday at 5 p.m., of cancer of the stomach, after an illness of several months.  He leaves a wife, two daughters and a son.  He was a veteran of the civil war, being a member of Co. C, 152 Ind. Regt., and also a member of the I.O.O.F. under whose auspices the funeral will be held from the home at 2:30 p.m. Wednesday.   (Goshen News)

Was Oldest Member of M.E. Church Of Goshen And Was Well Known In This City

After three months' suffering from complication of diseases, Mrs. Silas (Amelia) Shively, a resident of Elkhart county for 51 years and a member of the Methodist Episcopal church in Goshen for the past 48 years, died at her late residence, 618 South Second street, in this city at 4:46 o'clock this morning.

Mrs. Shively was born in Marion, O., September 29, 1841, and was a daughter of Mr. and Mrs. Jacob Bentz 51 years ago in April next, and shortly after her marriage moved with her husband to Goshen.  She came to this city ten years ago and has resided here since that time.

The deceased is survived by two daughters, Mrs. George Chester and Miss Daisy Shively, both of this city, and two brothers, Daniel Bentz, Custer, Ind., and John Bentz of Goshen, and one sister, Mrs. Eliza Hime of Indianapolis.

The funeral arrangements have not been completed as yet but the body will be shipped to Goshen for burial.

Silas Shively and family are located on the 1870 City of Goshen, 3rd Ward, Elkhart County, Ind. census.  Listed on the 1880 City of Goshen, Elkhart County census are Silas Shively age 42, wife Amelia age 39, son Enos J. age 18, daughter Mary A age 14 and daughter Daisy B age 4.  Amelia Shively is the head of the household on the 1900 Goshen City, Elkhart County census and the 1910 Elkhart City, 4th Ward, Elkhart County census.

Jonas Shively And Hester Miller Who Lived In Elkhart County, Indiana

Last week Reuben F. Shively who lived in Elkhart County was the subject of the Shively blog.  Reuben was the son of Jonas Shively and Hester (Esther) Miller. Jeanine Rhodes, Reference Assistant at the Elkhart Public Library in Elkhart, Indiana extracted the obituaries for Alonzo W. Shively and Joseph C. Shively who were also sons of Jonas Shively and Hester Miller.  

The family of John and Esther Shively is listed in the 1880 Harrison Township, Elkhart County, Indiana census.  Listed in the household are Jonas Shively age 56, wife Esther age 49, son-in-law Benjamin Berryman age 30 (line drawn through the information and marked as "Dead"), daughter Amanda Berryman, age 22, son Reuben Shively age 19, son Elonzo  Shively age 17, son Joseph Shively age 12, daughter Ellen Shively age 8, son-in-law (must be error as is grandson) Irvin Berryman age 8 months,  servant Mary Henton age 22.  The following obituaries give additional information on the lives of Jonas, Hester, Alonzo and Joseph Shively.

Death Of Jonas Shively

Jonas Shively, father of Joseph and A. W. Shively, of Elkhart, died this morning at his home in Goshen.  He was born in Starke county July 14, 1825, and came to Elkhart in 1845. In 1825 (error) he married Hester Miller.  There are five children.

In addition to the Elkhart sons the deceased leaves Reuben Shively, of Goshen, Mrs. Amanda Berryman and Mrs. Ella Stutzman of Goshen.  The deceased had been a sufferer from paralysis for some time.  The funeral will be held Friday afternoon at 3 o'clock from the German Baptist church at Goshen.

Mrs. Hester Shively Dead After Long Illness--Shively Store Closed

Mrs. Hester Shively, aged 83, died at the home of her daughter, Mrs. A. G. Stutzman of Goshen, after several weeks illness from old age and complications.  Mrs. Shively was born in Ohio, but went to Goshen in her girlhood and had lived there ever since.

Surviving are three sons, Joseph Shively and Alonzo Shively of Elkhart and Reuben Shively of Goshen.  Another daughter, Mrs. Amanda Berryman, lives in Detroit.  The Shivey shoe store, here, was closed today because of the death.

The funeral will be held from the Church of the Brethren at Goshen, Wednesday afternoon at 2:30.

The obituary for Alonzo Shively was located in The Elkhart Truth, Saturday, September 30, 1933, Page 2:

Alonzo W. Shively

Alonzo Wesley Shively, 70, who became a resident of Elkhart half a century ago and for many years was identified with the retail clothing trade here, died at his home, 1701 Stevens avenue, at 12:15 o'clock this morning.

Although he had been in ill health for several years, suffering from stomach complaint and complications, his death was the culmination of only a brief attack that assumed a critical stage.  He was stricken Wednesday night.

Born in Harrison township Nov. 25, 1862, he clerked in a store at Goshen before coming to Elkhart in 1882 to accept employment in the grocery store of J. J. Hoffman, then the leading merchant in that line here.  From there he went to the clothing store of Sam Crowl, subsequently clerking for Shackman & Nadel for a considerable period.  Then after engaging in the business for himself seven years, he became a clerk at the Herman Winer store, in which he was employed 29 years.  While with Mr. Winer he was seized with a severe and protracted illness, during which period his brother, Joseph C. Shively, shoe dealer, died on Dec. 12, 1928; and Mr. Shively had never resumed active employment since that time.

He was the son of Jonas and Hester (Miller) Shively.  On July 12, 1899, he was married to Miss Daisy Wrightsman of Elkhart, who survives, with three children: Mrs. Esther Gilkey of Elkhart, Chester Shively of South Bend and Miss Agnes Shively, at the parental home.  There also are  two sisters, Mrs. A. G. Stutsman of Goshen and Mrs. Amanda Berryman of Lakewood, Ohio.

The funeral will be held Monday with a service at the home at 2:30 p.m. and burial in Rice cemetery.

The services will be in charge of the Rev. C. L. Haney of the First Evangelical church and the Rev. H.  F. Stuckman of the First Brethren church.

Funeral For Shoeman To Be Held Wednesday At Goshen

Joseph C. Shively, for more than a quarter of a century a shoe dealer here, died at 4:30 Saturday afternoon at the Elkhart General hospital, to which he had been taken 11 days before for treatment for heart trouble.

The body was taken to the home of a sister, Mrs. Ella Stutzman, 613 South Main street, Goshen, and the funeral will be held Wednesday.  There will be a short service at the Stutzman home at 2 o'clock and a more extended service at the First Brethren church, Goshen, at 2:30 o'clock, with burial in the family lot in Oak Ridge cemetery, Goshen.

The Rev. H. F. Stuckman, pastor of the Goshen church, who on Saturday administered the rite of baptism to the patient, will officiate, assisted by the Rev. W. I. Duker, pastor of the First Brethren church of Elkhart.  Friends may view the body at the Stutzman home any time prior to the funeral.

Mr. Shively, who was 64 years old on Nov. 24, last, was born on a Harrison township farm 11 miles south of Elkhart.  He was the son of Jonas and Hester Miller Shively, natives of Stark county, Ohio, who came to Harrison township in 1850.  He remained on the farm home until 20 years old, and then worked on another place in the county until, at the age of 25, he went to Goshen and began employment as clerk in a shoe store owned by the late John Lusher, who for a long period was in mercantile business in Elkhart.

After several yearsin the Goshen store, Mr. Shively took a similar position in South Bend, which he left some 26 or 27 years ago to engage in the shoe business in Elkhart in partnership with William Stearns, a non-resident who was a traveling salesman for a shoe factory.  The store, conducted under the name of Shively & Co., was in the room at 226 South Main street until Mr. Shively bought Mr. Stearns interest in the business and moved it to its present location, 323 South Main street, at the time of the erection of that building.  He continued to use the firm name.

Surviving Mr. Shively are the following brothers and sisters:  Alonzo W. Shively of Elkhart, Rueben F. Shively of Wawasee Lake, Mrs. Amanda Berryman of Cleveland, O., and Mrs. Alvin (Ella) Stutzman of Goshen.

Mr. Shively was a member of the Elkhart Chamber of Commerce and of the Elkhart lodge of Elks.  He was a stockholder in the First Old State bank, and at one period served as vice-president of that institution.

Reuben F. Shively And Vicie Homan Who Lived In Elkhart County, Indiana

Reuben F. Shively was born on 16-Aug-1860 in Harrison Township, Elkhart County, Indiana.  He was the son of Jonas Shively and Hester (Esther) Miller. Reuben died on 4-June-1929.  Rueben was married 1st to Emma J. Hubler on 22-Aug-1882 in Elkhart County.  He married 2nd to Vicie Homan  in approximately 1889. Reuben and Vicie are listed on the 1900 Elkhart Township, City of Goshen, Elkhart County, Indiana census, the 1910 Elkhart Township, City of Goshen, Elkhart County, Indiana census and the 1920 Elkhart Township City of Goshen, Elkhart County, Indiana census.  Rueben was married 3rd to Lillie (last name unknown).

Reuben F. Shively, 68, brother of the late Joseph C. Shively, who died Dec. 8, passed away last evening at his home at Kale Island, Wawasee Lake, from a complication of diseases, which dated back to last February.  For two weeks he was a patient in the Elkhart General hospital.  The last 10 weeks of his illness his condition was known to be serious.

The body was taken to Goshen, to the home of Mr. Shively's sister, Mrs. Alvin Stutsman, 613 South Eighth street, where a service at 2:30 Friday will be followed by another service at 3 o'clock at the First Brethren church, of which Mr. Shively was prominent member.  The Rev. H. F. Stuckman will have charge.  Burial will be in Oak Ridge cemetery beside the grave of his first wife, Mrs. Visa Homan Shively, was was killed at Goshen on Oct. 15, 1920, when struck by a train while enroute to the cemetery.

Mr. Shively was born in Harrison township, Elkhart county, on Aug. 16, 1860, the son of Joseph and Hester Miller Shively, and spent his entire life in the county with the exception of his last seven years residence at the lake.  For a number of years he was employed as a foreman and cabinet maker by the Hawks Bros. of Goshen.  SInce moving to the lake he has been retired.

He is survived by his wife, Lillie Shively; a brother, Alonza W. Shively of Elkhart; and two sisters, Mrs. Stutsman of Goshen, and Mrs. Amanda Berryman of Cleveland.  The latter is confined to her bed by illness.

(Note there are differences from the research of original records and this obituary for Rueben. Corrections in the obituary would include that Visa (Vicie) Homan was his second wife and that Reuben's father was Jonas Shively).

Met Death After Taking Flowers To Grave Of Son

Mrs. Vicie Shively, aged 53 years, wife of Reuben F. Shively of Goshen, who was killed when struck by New York Central train No. 10 near the entrance to Oakridge cemetery, Goshen,  about 2 o'clock yesterday, as briefly told in The Truth, had been to the cemetery to place flowers on the grave of her son, Lonnie Shively, who died more than 25 years ago, at the age of six years.  He was the only child born to Mr. and Mrs. Shively.  Mrs. Shively had told her husband when he was home at noon that she was going to take the flowers to the cemetery as they probably would be the last to bloom in their yard this year.

Mrs. Shively had been totally deaf for six years and it is supposed in her hurry to catch a street car she failed to look for trains.  She was killed instantly.

Mrs.  Shively, who was a daughter of Mr. and Mrs. William Homan, was born in Milford on January 8, 1867.  Her marriage to Mr. Shively took place 34 years ago, and soon after they moved to Goshen.  Mr. Shively was employed a a foreman by the Goshen Novelty Co.  He was informed of the tragedy by a brother, Joseph C. Shively of this city, who had hurried to Goshen in his automobile.  Goshen friends decided it would be best to wait for his brother's coming before telling the husband of his bereavement.

Surviving Mrs. Shively besides her husband are two brothers, John W. Homan of Kokomo and Daniel Homan of this city, and four sisters, Mrs. Lorenzo Hall and Mrs. John Godschalk of this city, Mrs. William Tully of Nappanee and Mrs. Harvey Griffith of Milford.

The brother and sisters and the brothers-in-law, Joseph C. and Alonzo W. Shively of this city, all reached the stricken home within a short time after receiving news of the accident.

Mrs. Shively was an active member of the Progressive church of Goshen.

Martin Shively And Wife, Barbary Weimer, In Stark County, Ohio

Martin Shively, born 8-May-1812 and died 23-June-1895 in Stark County, Ohio was the son of Daniel Shively and Mary Magdalena Hauser.  Martin married Barbary Weimer in Carroll County, Ohio on 24-February-1842.  Barbary (Barbara) was born 16-Mar-1823 and died 20-May-1869.  Martin and Barbara Shively are buried in Liberty Cemetery, Paris Township, Stark County, Ohio.

A Pioneer of Stark County Dead--Eighty-three Years Old--Children in Canton

Martin Shively, a pioneer farmer of Stark county, died at his home at Pleasant Valley, about three miles west of Minerva, about 9 o'clock Sunday morning.  Mr. Shively was eighty-three years of age and his death was due to blood poisoning, superinduced by kidney trouble.  Mr. Shively was born in Stark county and resided in the country all his life, the greatest part of his years being spent at or near his late farm.  Mr. Shively leaves nine children.  Mrs. C. L. Hiner and Mrs. Phlip Walters, of Canton are daughters of the deceased.  He has forty grandchildren, and two great grand children.  His wife died in 1869.  Funeral will take place Tuesday from his late home, interment in Liberty cemetery.

Edward Eugene Shively And Wife, Mary C. Hanna, Huntingdon County, PA And Seneca County, OH

Edward Eugene Shively was the son of Jacob W. Shively and Mary Shelato (Shillito).  He was born in Shaffner's Creek Valley , Huntingdon County, PA in 1847.  Edward E. Shively was married to Mary C. Hanna in Seneca County, OH on 29-Nov-1882.  The recorder of the certificate listed his name as Edward E. Scheibley and the signature is written as Edward E. Shively.  At least two daughters were born to Edward and Mary;  Ada Shively born in Colport, Clearfield County, PA on 2-Nov-1886 and Nina V. Shively born 9-June-1888 in Tyrone, Blair County, PA.  Ada Shively married Frank A. Harris in Blair County, PA on 20-Jan-1906 and Nina V. Shively married Edward B. Chaney in Seneca County, OH on 9-Jun-1909.  The Ohio death certificate for Edward E. Shively lists his date of death as 20-Jul-1925 with burial on 23-Jul-1925 in Forest Hill Cemetery.

Killed In Auto Accident

Edward E. Shively, aged 78, a former resident of Tyrone, but for the past few years residing with his daughters,  Mrs. Frank Harris and Mrs. Edward Chaney, in Canton, Ohio, was struck and killed by an automobile in Canton on Tuesday.  Up until last evening nothing definite as to cause of the fatal accident had been learned.  Edward Eugene Shively was born in Shaffner's Creek valley, Huntingdon county in 1847.  When a young man he moved to Clearfield county and then to Tyrone.  His wife, Mary Hannah Shively preceded him in the grave about twenty years ago.  In addition to the two daughters above named are the following brothers and sisters: Samuel Shively, Tyrone; C. E. Edward E. Shively Run Down By Automobile

Edward E. Shiveley, aged about 78 years, a former resident of Tyrone, was struck and killed by an automobile in Canton, Ohio on Tuesday.  This very sad message was  received by Tyrone relatives last evening.  Mr. Shively, who was becoming rather feeble, had been making his home with his daughters, Mrs. Frank Harris and Mrs. Edward Chaney in Canton, and it is thought the fatal accident occurred while he was crossing over a street.

Edward Eugene Shively was a son of the late Jacob and Mary Shively.  He was born in Shaffer's Creek valley, Huntingdon county, in 1847.  His wife Mrs. Mary Hannah Shively preceded him to the grave about 20 years ago.

Many years of Mr. Shively's life were spent in Clearfield county in the vicinity of Tyrone.  He was a member of the Methodist church.

Surviving his death in addition to the daughters named above are these brothers and sisters: Samuel Shively, of Tyrone; C.E. Shively, of Clearfield county, Mrs. Clara Smyers, of Altoona and Miss Nina Shively of Tyrone.

Miss Shively left last night of Canton, Ohio, to attend the funeral which will occur in Canton, on Thursday afternoon.  Interment in Rose Hill cemetery, Canton, Ohio.

Edward P. Shively, 80, who lived with his daughter, Mrs. Ada Harris, 1200 Lippert rd. NE, was fatally injured, Monday evening, when he was struck by a machine driven by Donald Zellers, 1210 Shriver pl NE, near the intersections of Gibbs ave and 9th at NE, according to a police report.

Shively was returning home from a short walk and was crossing Gibbs ave when the accident occurred.  Zellers, the report says, was driving north on Gibbs ave.

Dies In Hospital

Shively was taken to Mercy hospital in Arnold's ambulance.  He suffered a fractured skull, a fracture of the right shoulder and right foot and lacerations about the forehead and head.  He died two hours later.

The man came to Canton two years ago from Pennsylvania. Since that time he has been making his home with his two daughters, Mrs. Ada Harris, 1200 Lippert rd NE, and Mrs. Nina Chaney, 1209 8th at NE.

Coroner T. C. McQuate will begin an investigation of the accident Tuesday morning.  Zellers is being held at police headquarters for questioning.  The body of Shively is at the Maughlman funeral parlors.

Harvey Hefelbower Shively, From Cumberland County And Dauphin County, Pennsylvania

Harvey Hefelbower Shively was born in March 1871 in Cumberland County, Pennsylvania.  He was the son of Simon Shively (born 14-Apr-1833 died 10-Oct-1896) and Rosanna Hefelbower (born 13-Sep-1829 died 17-Dec-1907).  Simon Shively was the son of David Shibley (Shively) who was born 30-Oct-1805 Perry County, PA died 30-Mar-1876 Cumberland County, PA and wife Elizabeth Clay who was born 17-Aug-1805 died 3-Sep-1854.  

The family of Simon and Rosanna Shively are listed on the 1880 Cumberland County, Newville Borough, PA census.  In the household are Simon age 47, wife Rosana age 50, daughter Florence Bell age 16, son William David age 14, daughter Laura Katherine age 13, son Harvey H age 8.  Florence Shively was married 23-Oct-1888 to John Milton Landis.  William Shively was married in May-1899 to Salina Susanne Hess.  Laura was married in 1897 to Amagiah L. Weaver.

The marriage for Harvey H. Shively and Ella R. Michael is located in Dauphin County, PA Marriage License Docket Volume 2 M, 1906.  They were married on 25-June-1906.  Harvey was 35 years old, parents Simon and Rosa, his 1st marriage, and occupation of carpenter.  Ella was 34 years old,  her 2nd marriage with her previous husband having died "6 years ago".    Their marriage was recorded in The Patriot, Harrisburg, PA, Wednesday, June 27, 1906, Page 6, Column 4:

Harvey Shively and Miss Ella R. Michael, both of this city, were married on Monday evening at the parsonage of Salem Reformed Church by Rev. Ellis N. Kremer, pastor.  They left shortly after the ceremony on a trip to Philadelphia, New York and Buffalo and on their return will reside in this city.

Searching For Brother Lost For Five Years

William D. Shively of Longsdorf whose brother has been lost for five years, yesterday addressed an appeal to THE PATRIOT asking that he be given aid in his search.  His brother is Harvey H. Shively.  He was last heard from in Harrisburg about five years ago.  He was working here then as a carpenter.

Seek Lost Brother

A "lost" brother, Harvey H. Shively, has been sought for over a year without success by relatives.  His brother, William D. Shively, who died on January 4 and was buried last Friday had long searched him.  William Shively lived in Dickinson and was ill only two hours before he died.  Other survivors are his wife and a son, Lester; and two sisters, Mrs. J. M. Landis,  of Brooklyn, and Mrs. A. L. Weaver, of Newville.

In Steelton, Dauphin County, PA in December 1915 Nicolo Kotur and Joso Bakic got into an argument.  Joso Bakic was found dead outside of the boarding house where they lived.   There are numerous articles in The Patriot relating to this murder.   In The Patriot, Harrisburg, PA, Tuesday, February 15, 1916, Page 1, Column 4  an article appeared that lists Harvey Shively as being present at the trial.  Not only was he present but as the article states he was pulled from being a spectator to being a member of the jury.  The article records:

Two spectators who entered the court room early yesterday afternoon did not get home last night.  They are Harvey H. Shively and William Metzgar, who were locked up with the rest of the jurors as the “guests” of Sheriff Caldwell.  They were picked from the audience after the regular panel had been exhausted. The other ten on the Kotur jury are:  John M. Madden, Millersburg, foreman; Joseph G. Beckwith, Seventh ward, city; George E. Eldridge, Ninth ward, city; Charles K. Hess, First ward, city; Henry W. Snyder, Ninth ward, city; Joseph Lutz, Thirteenth ward, city; Walter Liebfield, Derry township; Alpha Fraut, Steelton; John Dubbs, Hershey; and A. B. Gardner, city.

From the following article it is recorded that Harvey Shively and  fellow jurors found Nicholo Kotur guilty of first degree murder:

Kotur, Angered At Verdict Of Jury, Becomes Sarcastic In Remarks

Nicholo Kotur will be the first person from Dauphin county to die in the electric chair, unless means can be found by his lawyers to stay the penalty for murder in the first degree, the verdict returned by a jury late yesterday afternoon after little more than an hour’s deliberation.  He was convicted of killing Joso Bakic, a fellow-countryman, in a Steelton boarding house last December 22.

As the jurors, one by one, solemnly pronounced the word “guilty” the first trace of emotion he has shown since his arrest stirred in Kotur.  The three days’ trial was utterly devoid of anything dramatic on his part, and the impression grew that he was ignorant of English.  But at its conclusion the doomed man sprang to his feet.

Hot With Anger

“Thank you, Mr. Jurors,” he cried in accents that rang clearly over a tense courtroom.

His voice vibrated and his face colored with hot passion.  Hs head dipped quickly in the mockery of a bow.

Under the scorn and hatred blazing in his narrow eyes a few jurors turned red.  Then he strode toward (continued on Page 12, Column 6)  the door was was led back to his cell across the alley, composed once more.  On his way he remarked simply to Deputy Sheriff Hoffman: “Good-bye, everybody.  I go chair all right, all for notting.”

Nicholo Kotur was given a second trial and in December 16, 1916 he was found guilty once more.  From The Patriot, Harrisburg, PA, Tuesday,  October 2, 1917, Page 5, Column 3:

Kotur Paye Death Penalty In Chair

Nicolo Kotur, convicted of the murder of Joso Bakic at Steelton on Christmas 1915, yesterday paid the penalty in the electric chair at the Center County Penitentiary.  He was electrocuted at 7:10 a.m.

Could it be that Harvey Shively being involved in this trial had something to do with the fact that he seems to have "been lost" to his family?  Harvey and wife Ella are listed on the 1910 Dauphin County, PA, city of Harrisburg census. Harvey or Ella could not be located on the 1920 census records. It appears that Harvey H. Shively may have relocated to Jefferson County, OH.  Located on the 1930 Jefferson County, Ohio, Village of Toronto, Island Creek Township, 405 Main Street is an entry for Harvey H Shively, age 50, widowed, occupation Carpenter, Furniture and in the household is John Armour, a roomer, age 61, single, occupation as a Laborer for a steel mill.  There is an Ohio death certificate for a Harvey Shively, age 66, who died in Jefferson County, Ohio on 1-July-1937.  He is listed as living in the "Jefferson County Home".  The informant for the information on the death certificate was L. W. Adrian, Superintendent of the Jefferson County Home.  Harvey's birth information and parents were listed as unknown.
